Here is something most homeowners have never thought about, and it decides who can spray weeds on your place. When you ask a gardener to spray the weeds, whether they are legally allowed to do it depends on which state you are standing in.
Weed spraying licence requirements in Australia are not a technicality. The rules differ meaningfully around the country, and the difference is sharpest in Western Australia.

Weed Spraying Rules Are Not National
Agricultural and veterinary chemicals are approved nationally, but the rules about who may apply them commercially, what training they need and what records they must keep are set by each state and territory.
Broadly, using a domestic product on your own lawn is treated differently from applying chemicals commercially on someone else’s property. Once money changes hands, additional requirements can apply, and those requirements are not the same everywhere.
The practical result is that an operator who can offer weed spraying in one state may not be able to offer the same service after moving interstate until they hold the local qualification.
Western Australia Has the Strictest Rules
Weed spraying rules in WA come up constantly for franchisees working there.
“Our weed spraying requirements in Western Australia is different. We actually have the toughest requirements for weed spraying in Australia. So you do need to be licensed for that. That’s something that the guys can’t take that service on in Western Australia until they’ve got that license.”
— Peter Rogers, Jim’s Mowing regional franchisor for WA, on the Jim’s Mowing podcast
That is a clear statement about how the service operates there. A WA operator without the licence does not offer weed spraying, full stop. They will do the mowing, the gardening and the hedging, and the spraying goes to someone qualified.
If you are in WA and someone offers to spray your lawn, it is entirely reasonable to ask whether they are licensed.
Why the Rules Exist
The requirements are not paperwork for its own sake.
Spray Drift
Spray does not always stay where it is aimed. On a suburban block, that can mean a neighbour’s vegetable garden, a fence line of ornamentals, or a rainwater tank inlet.
Withholding Periods
Some products require a period before people or pets return to the area. Knowing that period, and telling the customer, matters.
Waterways. Many products are restricted near drains, creeks and stormwater entries, which on a residential block is closer than people realise.
Record Keeping
Commercial applicators are generally required to record what was applied, where, at what rate and in what conditions. That record is what protects you if something goes wrong afterwards.
Correct product and rate. More is not better. Over-application damages lawns, wastes money and can create residues.
What to Ask Before Anyone Sprays
Are you licensed or accredited to apply chemicals commercially in this state? A chemical licence is what separates a qualified gardener from someone guessing. In WA especially, this is a yes or no question with real consequences.
What product are you using, and is it safe for my grass type? Buffalo lawns in particular are sensitive to some common broadleaf herbicides. This is the most frequent cause of accidental lawn damage.
How long until it is safe for children and pets? There should be a clear answer taken from the product label.
What happens if it drifts? Which loops back to insurance. Every Jim’s franchisee carries $10 million public liability cover.
Is there a non-chemical option? Sometimes there is. Hand weeding, mulching, improving lawn density, or simply mowing more often can be enough, and some franchisees prefer to reach for chemicals last.
The Alternative Most People Overlook
Spraying is one tool. It is not always the right first one.
A thick, healthy, well-fed lawn suppresses common lawn weeds because there is no bare soil and no light reaching it. Mulch does the same in garden beds. Correct mowing height keeps grass competitive.
Plenty of weed problems are really density problems, and treating the density is more durable than treating the weeds every season.
What This Means when Choosing Someone
The person you hire should be able to tell you what they are applying, whether it suits your grass, how long to stay off it, and whether they are qualified to be applying it at all.
Anyone who cannot answer those is not someone to hand a sprayer on your property.
